Yanchenko suggests that defense industry manufacturers should only face a penalty of 0.1% of the contract value for each day of delay.

The current system of three penalties for defense industry manufacturers does not encourage contract fulfillment. Therefore, it is essential to reevaluate the penalty system. It has been proposed to maintain a daily fine for manufacturers, which amounts to 0.1% of the contract value for each day of delay, stated Galina Yanchenko, a member of parliament and chair of the temporary special commission on investor protection issues.

The current system of three penalties for defense industry manufacturers does not encourage contract fulfillment, so it is necessary to revise the penalty system. It is proposed to retain a fine for manufacturers, which is charged for each day of delay at a rate of 0.1% of the contract amount, stated Galina Yanchenko, a people's deputy and chair of the parliamentary temporary special commission (VSK) on investor rights protection.

"We propose to keep one of the three types of penalties - the most effective one. Specifically, the fine that is charged for each day of delay and amounts to 0.1% of the contract sum. This type of penalty will be manageable on one hand, and on the other hand, it will provide a daily incentive to expedite delivery. We regulate this through the bills: №12202 - amendments to the Commercial Code and №12258 - amendments to the Civil Code," Yanchenko said in an exclusive interview with the Interfax-Ukraine agency.

Additionally, she mentioned that the working group on investments in the defense industry, in collaboration with the Ministry for Strategic Industries of Ukraine, has developed a new version of government resolution №1275, which regulates the procurement of armaments during wartime.

"In this resolution, we also cancel the triple penalty and retain just one, the most effective. In this same resolution, we introduce an effective mechanism for recognizing force majeure, implement phased payments to special importers, and propose to address the issue of revising contract terms in the event of significant currency fluctuations," Yanchenko explained.

At the same time, she noted that this resolution "is still somewhere between heaven and earth."

The deputy also reported that work is underway to ensure that the state program "Affordable Loans 5-7-9%" can also be utilized by the defense sectors.

"Next year, the budget allocates half a billion hryvnias to cover the difference between the bank's commercial rate and the preferential rate. This is five times less than what our working group proposed. However, we hope that this shortfall will be addressed at the beginning of next year when we demonstrate that there is a significant demand for this program from armament manufacturers," emphasized Yanchenko.
