A resident of Kharkiv filed a lawsuit against Oschadbank after 64,447 hryvnias were withdrawn from her deposit account without her consent.
The bank refused to return the funds, citing internal operations via the "Oschad 24/7" system, according to the Unified State Register of Court Decisions.
Case Details
On March 14, 2023, the woman opened a deposit account at Oschadbank for 99,000 hryvnias at an annual interest rate of 11.2%. The deposit was intended to last for three months with automatic renewal.
However, on June 13, the bank withdrew 64,447 hryvnias from the client's account. The woman claimed that she had not conducted any transactions and had not shared her information with third parties. She contacted bank representatives and the police.
Oschadbank explained that the automatic renewal of the deposit was canceled on June 13 due to the "Oschad 24/7" system. By June 15, according to bank representatives, the deposit amount along with interest was returned to the client's account. However, on the same day, 64,000 hryvnias were transferred to another bank account — "Taxombank".
The bank emphasized that it is not responsible for transactions made through the "Oschad 24/7" system if the client's credentials were used. At the same time, access to the system is only possible through a code sent to the client's mobile number. The client was advised to contact the recipient of the transfer to recover the funds.
Court Ruling
The court determined that Oschadbank violated the client's rights by withdrawing funds without her consent. The financial institution did not provide sufficient evidence to refute its claim.
According to the court's decision, Oschadbank is required to return 64,447 hryvnias to the client.
