The European Business Association (EBA) supports bill No. 12442, which proposes amendments to the Criminal Code of Ukraine aimed at preventing violations by authorized representatives of territorial centers for recruitment and social support (TCRC and SS), as well as by chairpersons and members of military medical commissions (MMC).

"Following the intensification of mobilization processes and the changes occurring during the booking and critical status acquisition processes (at the end of the year, due to audits, a significant number of enterprises were unable to timely update their critical status due to the revision of procedures and the suspension of the booking process), there have been numerous cases where even booked employees of critical enterprises are being mobilized, and the MMC operates quite formally, without allowing the collection of all necessary documents to confirm health status," the organization reported on its website on Thursday.

It is noted that this leads to difficulties or even halts in company operations, negatively impacting the economy and, consequently, budget revenues, which are essentially the sole source of funding for the Armed Forces.

Additionally, time and resources are wasted proving the necessity of retaining highly qualified specialists in the economy, in whose training significant funds and time are invested.

The EBA explained that this draft law aims to rectify the situation and introduce accountability for the aforementioned actions of representatives of the authorized bodies.

In this regard, the association has expressed its support for this legislative initiative.

"Following the increased accountability of businesses for mobilization processes, this bill is a logical continuation of the reform of mobilization legislation, as the strengthening of responsibility should apply to all parties involved in the process," the EBA added.

According to the business community, this is why the adoption of the bill could help balance the system of public administration and create transparent and fair conditions for all parties, prevent corrupt abuses, and guarantee stable operations and predictability of production processes for businesses that are critical to maintaining the economy.

As reported, on January 27, the corresponding bill No. 12442 was registered in the Rada, proposing amendments to the Criminal Code to introduce criminal liability for violations of legislation on defense, mobilization preparation, and mobilization committed by heads of territorial recruitment and social support centers, as well as chairpersons and members of military medical commissions.

Among the authors of the bill are Maksym Pavliuk (Servant of the People faction), Vadym Ivchenko (Batkivshchyna), and Volodymyr Areshonkov (Trust parliamentary group).
