In Kharkiv, the Territorial Center for Recruitment and Social Support ( TCK ) unjustly fined a man for failing to appear for a summons, without sending him any notifications.
This is stated in the court ruling published in the Unified State Register of Court Decisions.
The man filed a lawsuit to annul the fine, asserting that he had not received any invitation to the military enlistment office.
The case materials indicate that the man challenged the TCK's decision, claiming that several provisions of the Code of Ukraine on Administrative Offenses were violated during the consideration of his case. Specifically, he was not informed of his rights, all circumstances related to the delivery of the summons were not established, and the reasons for his non-appearance were not clarified.
According to the applicant, he received no summons either at his address or via email, and he did not receive any messages from the TCK by phone or other means. He only learned about the fine from a local police officer, after which he again contacted the military enlistment office.
During the proceedings, the court found that the order imposing the fine lacked any evidence of the individual receiving the summons, and there was no confirmation of its dispatch in the case materials. These facts raised doubts about the legality of the TCK's actions.
As a result, the court deemed the actions of the TCK head unlawful, annulled the fine, and granted the man's claim. Additionally, the court ordered the TCK to reimburse the legal costs of the court fee amounting to 1211 hryvnias from the state budget.
